The agreement
These Terms of Service (the “Terms”) are a binding agreement between you (the “Customer”) and Blitz Global LLC, operating the PulsePigeon service (“PulsePigeon”, “we”, “us”). They incorporate by reference the Acceptable Use Policy, the Privacy Policy, and, where applicable, the Data Processing Addendum.
If you use PulsePigeon on behalf of an organization, you represent that you are authorized to bind that organization, and “Customer” refers to that organization.
The service
PulsePigeon is an email infrastructure platform for sending transactional and permission-based marketing email through our API, console, and delivery infrastructure, including managed provider routing and PulsePigeon-operated mail transfer agents (MTAs).
We may route your mail across one or more upstream providers and owned sending infrastructure. We may change providers or infrastructure to protect deliverability and reliability, provided the service level is not materially reduced.
Accounts, eligibility, and verification
You must provide accurate account information and keep it current. You are responsible for all activity under your account and for safeguarding your API keys and credentials.
Sending access is subject to verification and vetting. We may require domain authentication (SPF, DKIM, DMARC), sending-source attestations, and review of your use case before enabling production sending or increasing limits. We may decline, pause, or revoke sending access where verification is incomplete or where risk signals warrant it.
Acceptable use
Your use of PulsePigeon is governed by the Acceptable Use Policy, which forms part of these Terms. In summary, PulsePigeon is for mail you are authorized to send to recipients who expect it.
Prohibited without exception: purchased, rented, scraped, or otherwise non-consented recipient lists; unsolicited bulk email (spam); cold outreach to recipients who have no relationship with you; and any content that is unlawful, fraudulent, or designed to deceive recipients about its origin.
We operate automated and manual abuse controls, including pre-send content scanning, complaint and bounce monitoring, and sending throttles. We may suspend sending that threatens the deliverability or reputation of shared infrastructure or other customers.
Your obligations
You are solely responsible for your mail, and you agree to:
- send only to recipients who have consented to receive your mail, and to maintain records of that consent;
- honor unsubscribe and preference requests promptly, and include a functioning unsubscribe mechanism and a valid physical postal address in marketing mail as required by CAN-SPAM, CASL, GDPR, and other applicable law;
- maintain and respect your suppression list, and not attempt to circumvent suppression, throttling, or vetting controls;
- keep your sending domains authenticated and your DNS records accurate;
- comply with all laws applicable to your mail, including anti-spam, privacy, data protection, consumer protection, and export laws.
Plans, fees, and billing
Paid plans and usage-based charges are described on our Pricing page. Fees are billed in advance for subscription components and in arrears for metered usage above plan allowances, unless stated otherwise. All fees are exclusive of taxes, which you are responsible for.
We enforce plan entitlements and spend caps server-side. Where a hard spend cap is configured, sending may be paused when the cap is reached. Free-tier allowances, overage rates, and cancellation terms are as published at the time of purchase. Plan changes take effect as described in the console; downgrades may carry a grace period.
Data and privacy
Our handling of personal data is described in the Privacy Policy. Where we process personal data contained in your mail on your behalf, we do so as a processor under the Data Processing Addendum, using the subprocessors listed on our site.
You retain all rights to your content and recipient data. You grant us a limited license to process it solely to provide, secure, and improve the service, and to meet legal obligations.
Suspension and termination
We may suspend or limit sending immediately to address an active abuse, security, deliverability, or legal risk, and will act proportionately. For other breaches, we will provide notice and a reasonable opportunity to cure where practicable.
You may cancel at any time from the console. On termination, your right to send ends, and we will make your data available for export for a limited period before deletion in accordance with our retention practices. Suppression data may be retained where required to prevent unlawful sending.
Warranties and disclaimers
We will provide the service with reasonable skill and care and in line with any published service level agreement. Email delivery depends on third parties (mailbox providers, DNS, upstream networks) outside our control, and we do not guarantee inbox placement or delivery of any specific message.
Except as expressly stated, the service is provided “as is” without warranties of any kind, to the maximum extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our aggregate liability arising out of or related to the service will not exceed the amounts you paid to us for the service in the twelve months before the event giving rise to the claim.
These limits do not apply to your payment obligations or the Acceptable Use Policy.
Changes to these Terms
We may update these Terms from time to time. Material changes will be posted here with an updated effective date and, where required, communicated to you. Your continued use after changes take effect constitutes acceptance.
